DWI and DUI Information

DWI (Driving While Intoxicated, Driving While Impaired), DUI (Driving Under the Influence), OVI (Operating a Vehicle Under the Influence), OVWI (Operating a Vessel While Intoxicated),  OUIL (Operating Under the Influence Liquor), OUI (Operating Under the Influence), APC (Actual Physical Control), DWAI (Driving While Ability Impaired) and OWI (Operating While Intoxicated) are all different definitions of drunk driving charges in the United States.  For example, Texas and New York call drunk driving DWI and California calls drunk driving DUI.

All states have adopted drunk driving or legally intoxicated when your BAC (Blood Alcohol Content) level is .08 or higher.  Some states like Texas will arrest you for DWI even if your BAC level is less then .08.  New York will arrest you for DWAI if your BAC level is between .05 and .07.  Both Texas and New York have a Zero Tolerance Laws for drivers under the age of 21.

You can you loose your Driver's License for a DWI / DUI or Drunk Driving Arrest?

Most states immediately start the proceedings to suspend your driver's license after being arrested for DWI, DUI, alcohol related offenses or drunk driving.  In Texas, you have only 15 days from the date of your DWI arrest to request a hearing to save your Texas Driver's License and in New York, if you are convicted of a DWI or DWAI you have to enroll in the New York State's Drinking Driver Program.

Once you have a Occupational Driver's License or a Conditional Driver's License, most states like Texas, New York and California require you to have a ignition interlock device installed in your vehicle as a condition of your driving privileges.
